TERMS & CONDITIONS.

The terms that apply to goods and services supplied by ASA Tiles Australia.

These terms apply to goods and services supplied by ASA Tiles Australia. Placing an order with us means you agree to them.

Who you are dealing with

ASA Tiles Australia is a business of MTS Group Aus Pty Ltd, ABN 31 166 945 419, trading from Shop 9, 1000 Ann St, Fortitude Valley QLD 4006. In these terms, "we", "us" and "our" mean MTS Group Aus Pty Ltd.

Quotations and pricing

Quotations are valid for 7 days unless otherwise stated. Prices exclude GST unless otherwise stated and are subject to product availability and confirmation at the time of order.

Orders and payment

Payment is due on receipt of invoice unless credit terms have been agreed in writing. Accepted methods may include credit card, bank transfer or electronic funds transfer; details appear on your invoice.

Orders are not released, collected or dispatched until cleared payment has been received, unless approved credit terms apply.

Availability and special orders

Availability and stock levels are subject to change until an order is confirmed. Special-order, indent, custom and project-specific products may not be cancelled or returned once they have been ordered from the supplier.

Lead times for special-order and indent products are estimates, and may be affected by manufacturing, shipping, customs, freight or other circumstances outside our control.

Product variation

Tile, natural stone and other surface products vary in colour, shade, texture, pattern, calibre and appearance between samples, between production batches and between individual pieces. This is inherent to the material and is not necessarily a defect. Where possible, order enough material for each area at the same time to minimise batch variation.

Quantities and plan take-offs

We may assist with preliminary quantity estimates from plans, drawings or measurements you supply. All quantities are estimates and must be checked and confirmed by you, your builder or your installer before ordering. Allow additional material for cuts, wastage, breakages and future repairs. We accept no responsibility for shortages or excess resulting from quantities supplied or approved by you.

Delivery and collection

We may arrange delivery through third-party freight providers to your nominated address. Delivery dates and times are estimates and may be affected by circumstances outside our control. Freight charges apply unless otherwise stated and are confirmed before dispatch.

You are responsible for safe and suitable access to the delivery location, and should tell us about access restrictions before delivery is arranged. Collection may be available from selected warehouses and suppliers by prior arrangement.

Inspection, damage and breakages

Please inspect goods as soon as practicable after delivery or collection. Report visible damage, breakage, incorrect product or a quantity discrepancy within 48 hours of receipt. We may ask for photographs of the product, packaging and damage.

Inspect and approve all products before installation. Installing a product is generally taken as accepting its appearance, shade, calibre and suitability, except where you have rights or remedies under the Australian Consumer Law.

Returns

Returns of non-faulty stocked products may be accepted at our discretion and that of the relevant supplier. Approved returns must be unused, undamaged, in saleable condition and in original packaging, and may incur a restocking fee of up to 25%. Freight and other costs of returning non-faulty products are yours.

Special-order, indent, custom, clearance and project-specific products cannot generally be returned for change of mind. Contact us before returning anything; products returned without prior approval may not be accepted.

Faulty or damaged products

If you believe a product is faulty or damaged, contact us as soon as possible and before installation. We may ask for photographs, samples or other information reasonably required to assess the issue.

Cancellations

Orders may be cancelled within 24 hours of placement where the goods have not already been ordered, allocated, processed or dispatched. Later cancellations may incur a fee of up to 25%. Cancellation may not be possible for special-order, indent, custom or project-specific products once placed with the supplier.

Refunds

Approved refunds are processed to the original payment method where practicable. Processing times vary with the payment method and financial institution.

Your rights under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.

Our liability

To the extent permitted by law, and other than the guarantees above, our liability for any claim arising out of the supply of goods or services is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.

To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit, loss of use, or the cost of removing or reinstalling product, other trades or associated works.

Governing law

These terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.
